5 years ago, the U.S. Census revealed that 4.85 million cohabiting couples were more than 1,000% since 1960, when there were 439,000 couples. Recent studies found More than half of newlyweds lived together, at least briefly, before walking down the aisle. Some of the partners are getting married and many can not marry for several reasons. It's easy for these couples, including same-sex couples to unite, but can be a legal disaster when they break up – like most of them do.

Who receives the payment? What personal gifts are considered separate property? What assets are created by the relationship? Who pay income taxes on the assets of the joints? Who is responsible and who has rights to the children of these unions?

Already in 2002, 10% of cohabiting couples in the United States compared to 3% in Japan and Israel. More than 17% live in France and 22% in Australia.

There are many reasons that lead couples decide to live together as if to test compatibility or establish financial security before marrying. Same sex partners can avoid high taxes on the rent paid by rent from two marriages (in USA), making a small difference between the commitment to live together and the commitment of marriage. The Social Security retirement benefits are penalizing the elderly couple to get married or remarried, and this weighs in the decision to live together.

Merle H. Horwitz, Los Angeles attorney, wrote one of the first books on cohabitation in the 1980s, when their life together began spiraling upward. He stood before of the curve in understanding the legal entanglements that often follow these relations. His book gave couples a guide and a contract to gather and spread.
